Usnick’s involuntary manslaughter verdict overturned

A woman found guilty of involuntary manslaughter in 2017 has had her verdict overturned by the Missouri Western District Court of Appeals.

Emily Usnick was tried and found guilty of hiding her newborn baby inside the trunk of a car in 2009 in Miller County.

Usnick had given birth to the baby at home, medically unattended. The judge found her to be responsible for the child’s death.

She was sentenced to five years.

The appeals court that overturned the verdict cited a lack of evidence on behalf of the prosecutors in the case, and that it wasn’t enough to submit the case to a jury.

The Miller County Prosecutor’s Office told ABC 17 News that it is reviewing the decision and would “act accordingly.”
